What is an EVV Proprietary System?
An Electronic Visit Verification proprietary system is an HHSC-approved EVV system that a program provider or Financial Management Services Agency may opt to use instead of an EVV vendor system from the state vendor pool that:
- Is purchased or developed by a program provider or FMSA;
- Is used to exchange EVV information with the EVV Aggregator;
- Complies with Section 531.024172 of the Texas Government Code and
- Complies with all HHSC EVV standards, rules and reporting requirements.
EVV System Options
Texas Medicaid program providers and FMSAs have two options for complying with the requirement to use an EVV system.
Option 1: State EVV Vendor Pool
Program providers and FMSAs can choose to use an EVV vendor system from the state EVV vendor pool managed by the Texas Medicaid and Healthcare Partnership.

Option 2: EVV Proprietary System
Program providers and FMSAs may choose to seek HHSC approval to use an EVV proprietary system instead of an EVV vendor system from the state vendor pool.
HHSC may recognize a proprietary system, whether purchased or developed by the program provider or FMSA. EVV Proprietary System Operators will be responsible for their system meeting all provisions of state and federal laws, rules, regulations, policies, and guidelines, including the requirements of Section 531.024172(g) of the Texas Government Code and all other EVV requirements.

A program provider or FMSA must have a developed and compliant proprietary system which meets all HHSC requirements by the Readiness Review begin date for their chosen session.
HHSC will allow up to six program providers and FMSAs to register for each Readiness Review session by submitting a completed an EVV Proprietary System Request Form to TMHP. Program providers and FMSAs will be accepted into a session on a first-come, first-served basis determined by the date a complete and signed form is received.

HHSC is allowing program providers to report costs for developing and operating an EVV proprietary system beginning in cost report year 2020. HHSC will consider these reports during its regular biennial fee reviews and legislative appropriation request process to calculate rates related to proprietary systems. The soonest rates may be affected is fiscal year 2024.
HHSC is also working on a process to collect enough financial information to review rates for providers and FMSAs who do not submit cost reports. HHSC will update this webpage and notify providers and FMSAs when more information is available.
2021 Implementation Timeline
Program providers and FMSAs that want to use a proprietary system have two opportunities to get HHSC-approval during fiscal year 2021.
