HHSC adopted rules in: Chapter 744, Minimum Standards for School-Age and Before or After-School Programs, Chapter 746, Minimum Standards for Child-Care Centers, and Chapter 747, Minimum Standards for Child-Care Homes.

HHSC reminds HCS program providers that HHSC, with the assistance of Texas Medicaid & Healthcare Partnership (TMHP), is conducting on-site assessments of 3-person residences, 4-person residences, and Host Home/Companion Care (HH/CC) settings to ensure compliance with the federal HCBS Settings Rule.

Child Care Regulation (CCR) invites you to review and provide comments on the potential rule changes in Chapter 749, Minimum Standards for Child-Placing Agencies from Feb. 15 through March 1.

HHSC has posted the state’s HCBS Settings Rule final Statewide Transition Plan (STP) for public comment. Notice of the STP was published in the Jan. 13, 2023 edition of the Texas Register. However, due to errors in the publication, a revised notice regarding the STP is expected to be published in the Jan. 27, 2023 edition of the Texas Register.

Texas Workforce Commission Child Care and Early Learning Division and Texas Health and Human Services Child Care Regulation have developed a “Roadmap to Success” to support newly licensed/registered child care programs in Texas.

HHSC will submit a final Statewide Transition Plan (STP) to the Centers for Medicare and Medicaid Services (CMS). The STP is posted for public comment.

Child Care Regulation has proposed updates to the Criminal History Requirements Charts. The proposed updates were published in the Texas Register and CCR is accepting public comments from Jan. 6–Feb. 5, 2023.

Effective Dec. 18, Child Care Regulation is adding a “Transfer Date” field on the “Agency Home Change Request” page of the CCR Account for child-placing agencies.

CCR uses feedback during the informal comment period to determine what (if any) changes need to be made before the rules are proposed and published in the Texas Register for formal public comment.
