HHSC reminds HCS program providers that HHSC, with the assistance of Texas Medicaid & Healthcare Partnership (TMHP), is conducting on-site assessments of 3-person residences, 4-person residences, and Host Home/Companion Care (HH/CC) settings to ensure compliance with the federal HCBS Settings Rule.

This information letter provides guidance on the process a program provider must follow to request an enhanced staffing rate for the provision of off-site individualized skills and socialization.

The purpose of this letter is to provide guidance to local intellectual and developmental disability authorities (LIDDAs) and Home and Community-based Services (HCS) Program providers regarding implementation of the federal Home and Community Based Services (HCBS) settings regulations.

IL 2023-04 is posted to the HHS site DBMD.

HHSC has posted the state’s HCBS Settings Rule final Statewide Transition Plan (STP) for public comment. Notice of the STP was published in the Jan. 13, 2023 edition of the Texas Register. However, due to errors in the publication, a revised notice regarding the STP is expected to be published in the Jan. 27, 2023 edition of the Texas Register.

HHSC will submit a final Statewide Transition Plan (STP) to the Centers for Medicare and Medicaid Services (CMS). The STP is posted for public comment.

IL 2023-03 is posted to the HHS site for HCS, TxHmL, LIDDA, FMSA and EVV.

HHSC approved payment rates for the Individualized Skills and Socialization in the DBMD waiver, HCS, and TxHmL programs, effective Jan. 1, 2023.

Effective Jan. 1, 2023, HHSC adopts new Individualized Skills and Socialization rules for the HCS, TxHmL and DBMD Programs.
