HHSC cancelled the rules project related to Validating Controlling Persons Lists in Child Care Operations. The rules in this project would require a child care operation to validate its controlling persons list on a scheduled basis using the operation’s Child Care Regulation Account.
The cancellation of this project does not change current rule requirements related to maintaining a current controlling persons list. A child care operation must provide information to Child Care Regulation about each controlling person at the operation:
- When applying for a permit.
- Once the operation has a permit:
- as soon as possible, or
- within two days after a person becomes a controlling person or ceases to be a controlling person at the operation.
For more information on the current requirements, review:
- Chapter 744, Minimum Standards for School-Age and Before or After-School Programs, §744.305(a)(7).
- Chapter 745, Licensing, Subchapter G, Controlling Persons.
- Chapter 746, Minimum Standards for Child-Care Centers, §746.305(a)(7).
