As of Jan. 1, 2023, HHSC will no longer allow Intermediate Care Facilities to participate in emergency temporary closures found in the ICF FAQ and Response Plan. Facilities who choose to participate in temporary closure practices must do one of the following no later than Jan. 1, 2023:
- Reopen and resume regular business practice; or
- Voluntarily close in accordance with Title 26 of the Texas Administrative Code §261.218 and suspend the facility's certified capacity in accordance with 26 TAC §261.218, if the licensee meets the requirements for suspension and chooses to do so.
Facilities who fail to either reopen or voluntarily close and suspend their certified capacity, if applicable, will be subject to enforcement action.
