Informal Public Comment Period Regarding Inspections, Investigations, Confidentiality, and Voluntary Actions

HHSC Child Care Regulation is accepting comments on the potential rule changes regarding the movement of the content of Title 40, Part 19, Chapter 745, Subchapter K to Title 26, Chapter 745, Subchapters B, I and K.

The primary purpose of the rule changes is to continue carrying out House Bill 5, 85th Legislature, Regular Session, 2017, which directed DFPS to become a stand-alone agency that is separate from HHSC.

The rules are also being updated to delete any DFPS responsibilities, to be consistent with current practices, and for better readability and understanding.

This is an informal opportunity to provide comments on the drafted rules early in the rule development process. CCR uses feedback to determine what (if any) changes need to be made before the rules are proposed and published in the Texas Register for formal public comment.

Send comments on the potential rule changes by Sept. 8 to Child Care Regulation by one of these two methods:

  • Email HHS Child Care Regulation Rules
  • Mail to: Gerry Williams, Rules Writer (22R083), Child Care Regulation, Texas Health and Human Services Commission E-550, P.O. Box 149030, Austin, TX 78714-9030.

Include the specific rule number(s) you are commenting on. This will help us fully understand and appropriately consider your comment.

Visit the HHSC website for more information about the HHSC rulemaking process and tips for submitting comments.
