Emergency rules for Home and Community-based Services program providers that contain the COVID-19 requirements for visitation expired June 16.
The following rules expired June 16:
- 40 TAC §9.199 - HCS Provider Response to COVID-19 Expansion of Reopening Visitation.
HCS providers are still expected to comply with §9.198, Program Provider Response to COVID-19 Emergency Rule. Visitation requirements for essential caregivers and clergy in a disaster can be found in Texas Administrative Code Chapter 570.
HHSC published a new Program Provider Response to COVID-19 Emergency Rule for HCS program providers, effective June 17. The new rule:
- Updates definitions.
- Outlines requirements for infection control.
- Continues certain flexibilities for HCS program providers.
