TEXAS WORKS INSTRUCTIONS

PURPOSE

To serve as a notice to clients about:

TANF/CSS Medicaid Programs

Automatic action to deny, lower, place on hold, or pending denial of TANF and Medicaid benefits.

Aged and Disabled Programs

  • Worker action to deny medical assistance only (MAO) for the aged and disabled.
  • Automatic action to hold medical assistance only (MAO) for Model Waiver cases who reach their 18th birthday.

PROCEDURE

Form H1029 is automatically produced by state office when:

TANF/CSS Medicaid Programs

  • The TANF grant is to be lowered/denied because the $30 only or 1/3 disregard is being removed automatically.
  • The TANF grant is to be denied and the family will receive Medicaid only because the $30 only or 1/3 disregard is being removed automatically.
  • The TANF warrant or Form H3087, Medical Care Identification Card, is returned to state office. (Data control hold codes C, D, and E, or fiscal hold codes F, G, and H are used.)
  • The client's TANF grant is to be lowered or denied because of removal of a 19-year-old child.
  • The TANF caretaker is automatically registered for employment services because the youngest child is three years old.
  • Annual School Subsidy Payment (ASSP) has been authorized and issued to the TANF/TANF-SP household.
  • TP 40 eligibility as a pregnant woman is ending.
  • TP 48 eligibility is ending for a six-year-old child.
  • The newborn's TP 45 case will be denied because
    • the child is one year old.
    • forced coverage established by state office Data Control is for a limited period.
    • the mother's coverage is denied.
  • The Medically Needy budget period is ending.
  • Medical coverage on TP 07, 20, 37, 44, 46, 47, or 55 is to be removed or the case denied because of a 19-year-old child.
  • The household's transitional Medicaid period is to be shortened to end after six months because the client failed to return a complete fourth month Medicaid report.
  • The household's transitional Medicaid is denied because the client failed to return a complete fourth month Medicaid report.

Aged and Disabled Programs

  • Form H1000-A/B is submitted to deny an MAO application or case.
  • A Model Waiver case is placed on automatic hold because it is the month of the 18th birthday.

Form H1029 is not printed for cases when MAO for the aged and disabled is denied because of death or applications filed in error.

The following information is printed on Form H1029:

  • The date of the notice,
  • The case number or application number,
  • The name and address of the client,
  • The action taken on the case (lowered, denied, on hold),
  • The reason for the action, and
  • Other information including the client's right to appeal the decision and to contact the local eligibility determination office if the client has any questions or wants to request a fair hearing.

Mailing Cycle

Forms H1029 are mailed:

TANF/CSS Medicaid Programs

  • With the TANF warrant one month before the effective date of the action for grant reduction or denial because of the automatic removal of 1/3 income disregard.
  • Daily when a warrant or Form H3087 is returned to the state office.
  • After computer cutoff in the month a child reaches age 19 if he is not removed from the case or the case is not denied because of worker action.
  • After computer cutoff in the month the youngest child becomes three.
  • Annually in August when the Texas Legislature has allocated funds for the ASSP.
  • After computer cutoff in the last month of
    • the Medically Needy budget period, or
    • TP 07, 20, 40, or 44, 45, 46, or 48 eligibility.
  • After computer cutoff in the next to the last month of TP 37 eligibility.
  • Daily when Form H1000-B processes to shorten transitional Medicaid.
  • After computer cutoff in the sixth month to deny a shortened TP 07 transitional Medicaid case.
  • After computer cutoff in the fifth month to deny a shortened TP 37 transitional Medicaid case.

Aged and Disabled Programs

  • Daily to denied aged and disabled MAO clients after processing of Forms H1000-A/B is completed.
  • Daily to Model Waiver cases after automatic hold action due to 18th birthday.

Although the client receives Form H1029 explaining the action taken on his case, the worker should attempt to adequately interpret the decision for the client.

Form Retention

The department does not keep copies of Form H1029.

MEDICAID ELIGIBILITY INSTRUCTIONS

CATEGORIES 1, 3, 4 MAO INSTRUCTIONS
NOTICE OF CASE ACTION

PURPOSE

To serve as a notice to clients about

  • automatic action to hold medical assistance only (MAO) for Type Program 19 individuals who reach their 18th birthday or Type Program 22 individuals who reach their 65th birthday.
  • automatic action resulting from denials due to state office conversions in January and April each year.

PROCEDURE

Form H1029 is automatically produced by state office when

  • Type Program 19 case is placed on automatic hold because it is the month of the 18th birthday.
  • An active/hold case is denied due to state office conversions, such as the January cost-of-living adjustment (COLA) conversion and the April Federal Poverty Level (FPL) conversion.

Form H1029 is not printed

  • for cases denied because of death (code 059)
  • for applications denied because they were filed in error (code 096), or
  • when a Form H1000-A/B is submitted to deny an application or case.

The following information is printed on Form H1029:

  • date of the notice;
  • case number or application;
  • name and address of the client;
  • action taken on the case (lowered, denied, on hold);
  • reason for the action; and
  • other information, including the client's right to appeal the decision and to contact the local eligibility determination office if the client has any questions or wants to request a fair hearing.

Forms H1029 are mailed daily to Type Program 19 cases after automatic hold action due to 18th birthday.

Forms H1029 are mailed once a year to cases denied due to state office January COLA and April FPL conversions.
