Purpose

Department of Family and Protective Services (DFPS) Child Protective Services (CPS) staff use this form to request due process for someone in a prospective or current foster/adoptive home that is a designated perpetrator in the Central Registry. This form is managed by Texas Health and Human Services Commission Child Care Licensing.

Procedure

CPS staff in the Foster and Adoptive Home Development (FAD) program use this form to request a State Office of Administrative Hearing (SOAH) for a person named as a designated perpetrator in the Central Registry. Due process is offered to anyone who requires a background check because of his or her role within a potential foster or adoptive home when verification or approval of the home is being pursued.
